Adalytics Loses Bid to Dismiss Colossus Defamation Case

The court rules against Adalytics, allowing Colossus’ defamation case to proceed

Last year, Colossus SSP filed a civil lawsuit against Adalytics for defamation, injurious falsehood, and false advertising. This legal action was in response to a blog post published on May 10, 2024, which attempted to discredit our company, technology, and business practices. The blog post contained numerous inaccuracies and falsehoods and demonstrated a fundamental misunderstanding of Colossus SSP and our business operations.

The lawsuit alleged that Adalytics coordinated what was similar to a short-seller “report” on Colossus SSP. According to our filing, Adalytics caused "material and substantial harm by publishing an inaccurate blog post." The filing further stated: "These false and misleading statements were made in an effort to damage Colossus SSP's business and reputation for the purpose of selling Adalytics' services and winning new business from ad buyers."

Today, we are pleased to share key updates with our shareholders, partners, and customers on the status of our legal action, as we secured a significant victory yesterday that follows a series of legal developments reinforcing our position regarding the Adalytics post.

In an August 2024 motion to dismiss our suit, Adalytics initially attempted to walk back its claims, stating, “there is nothing in the Blog Post that comes even close to claiming that Colossus SSP is defrauding brands.” This marked a key milestone in our case.

We are now pleased to share another significant development: the court has denied Adalytics' motion to dismiss our case on all counts, including defamation. The judge has ruled that we have adequately pled our claims and damages, allowing our lawsuit to proceed fully. This decision validates the substance of our allegations regarding inaccurate and false statements targeting our technology and business. It confirms that we have properly demonstrated how these misrepresentations have impacted Colossus SSP.

While litigation is never our preferred approach, we remain committed to defending our reputation and correcting the record when false information about our platform is published. This decision also reinforces the need to hold accountable those who spread misleading and harmful claims about businesses in our industry, which is increasingly common.

As this process continues, we will pursue accountability for Adalytics and any parties involved in creating the blog post. We appreciate the ongoing support of our customers and partners as we see this case through, and we will continue to drive our business forward.
